Terms And Conditions

Purpose:
The purpose of these terms and conditions is to summarize our agreement to you and what we expect for payment and other terms from you.  The intent of this section is to make sure we’re completely clear and there is no mis-communication.  If you have any concerns or questions please contact us.  We want this to be a smooth and successful transaction, so we can build a strong working relationship.  We want you to be as successful as possible with your new SkyCart! online store.

 

Cost Summary:

Our start up packages include everything you’ll need to get started and run your new SkyCart! online store for the lifetime of our relationship.  As long as you work with us and pay your monthly maintenance fee on time, all of the services listed below are included at no additional charge, ever! (Services Include: Website Domain Name, Website hosting account, SSL, Shopping Cart Software, Email Marketer Integration, Site Optimization Package, Quebert Email Marketer Basic Account Access, Future Features & Enhancements, and 25 hours of assistance customizing and training you on how to use our SkyCart! software).

 

If your business grows and you need to upgrade to our more advanced versions (professional or ultimate), the only additional charge is the difference between the packages.  We’d be glad to help you upgrade.  The 'Mall' version of our product is now available but would require a dedicated server so please ask for special pricing.

 

Return on Investment (ROI):

Initial Commitment: $1895 to $3495 based on version – 33% due at the start of our agreement, Balance due in 30 days.

 

Monthly on-going commitment: $79 tr $199 per month for the life of the relationship.  We offer 1 month free if you want to pay annually instead of monthly.  This can be paid by check or via PayPal.  PayPal accepts MC and Visa so you’re welcome to use their service to pay us if you’d like a credit option.  The transaction fees are taken out of the money paid to us on our side of the transaction so there is no additional cost for you to pay this way.  We prefer check, of course, but will accept payment either way. 


If you decide to go monthly an auto-draft from your bank to our bank must be setup to minimize the amount of time that is spent collecting and invoicing.

 

Other costs to consider:

If you need assistance with design or site changes beyond our initial 25 hour commitment, we charge $65 per hour ($500 for a block of 8 hours).  Since each site includes an easy to use admin area, we can both access it at the same time and perform the training you need remotely over the phone; responding to your needs very quickly and resolving them in less time.  (Blocks of time can be purchased for a lower hourly rate)

 

If you want to have any of our templates modified, so they are more unique, we can do that for you.  There is a one time $250 template modification charge.

 

Agreement Termination:

If we decide to terminate our agreement because you have late or unpaid maintenance fees 3 months in a row, legal action may be pursued to collect unpaid balances in addition to any labor or attorney fees.  Please take the time to communicate with us if you plan to be late or are having trouble meeting your monthly maintenance fee commitment.  We’d much rather have the opportunity to work with you and figure out a solution, than pursue legal action.  Reinstating your account after you’ve been terminated could cost up to the full amount of your initial payment, so it’s important for us to talk before this happens. 

 

If you decide to terminate our agreement and move your eCommerce website to another provider, we’ll provide you with a way to export your web page content, graphics, catalog and customer data.  You also retain ownership of your domain name.  A transfer fee of $150 will be charged and all account fees must be paid up to date for us to release any data to you or your new web developer.  We understand that changes occur, so we won’t have any hard feelings, but will need to charge for our time to help you move your data successfully.  We hope you understand.  We also hope that you would contact us if you’re having any questions or concerns with your account.  We’ll do whatever we can to solve it.  We’re passionate about keeping you as a lifetime customer.

 

All other services: web hosting, SSL, Shopping Cart Software, Email Marketer Account Access, SEO, are all the intellectual property of or arranged by N.E.W. Results, LLC and cannot be moved or relocated.
